HOW TO ENTER – To be considered valid, entries must be made during the Contest Period by (i) Opting in to the Home Outlet Email and/or SMS Program. By entering, each entrant confirms that they meet the eligibility requirements as set out above and agree to these Terms and Conditions and Sponsor’s decision in all matters related to the Contest, which are final and binding in all matters relating to the Contest. Automated entries are prohibited, and use of any automated devices will result in disqualification. Receipt of entries may not be acknowledged, and proof of submission will not be deemed to be proof of receipt by Sponsor. All entries become the property of the Sponsor. Sponsor is not responsible for any lost, late, undelivered, misdirected, incorrect or inaccurate entries whether caused by hardware, software, or Internet resources associated with or utilized for the Contest, or by technical or human error during the submission and/or processing of entries.

This Contest is strictly for promotional and entertainment purposes and may not be used in connection with any form of gambling. The Contest is subject to all federal, state and local laws and regulations and is void where prohibited by law. Any questions, concerns or complaints regarding the promotion will be directed to the Sponsor. Each entrant acknowledges that the Contest is in no way sponsored, endorsed or administered by, or associated with, any participating parties’ social media channels, including Facebook, Twitter, Instagram or YouTube.

 

SPONSOR - E.C. Barton & Company d/b/a Barton’s Home Outlet (“Sponsor”).

 

ELIGIBILITY - The Contest is open to any US citizen currently residing in the U.S. who is 18 years of age or older by the beginning of the Contest Period, except where prohibited by law. Sponsor reserves the right to verify the eligibility of each entrant. Employees, former employees, and relatives of employees are excluded from entering. Sponsor reserves the right to disqualify entrants if there is evidence of tampering. The Contest shall be open to all eligible persons regardless of race, color, sex, gender identity, sexual orientation, national origin, religion, age, disability, marital or veteran status, or any other legally protected status. By submitting an entry to the contest, each participant agrees and acknowledges that prizes—issued as Home Outlet gift cards—will be awarded to unique winners after the contest period concludes. Winners will be selected through a combination of internal panel review and public voting. Participants further confirm and warrant to the Sponsor that: (i) all selected winners must reside within a 120-mile radius of a Home Outlet store; (ii) no individual may win more than once during the contest period; and (iii) a maximum of five winners will be selected from each of the states of New York and Florida.

 

AGREEMENT TO TERMS AND CONDITIONS - By participating in the Contest, each entrant agrees to abide by these Terms and Conditions, including all eligibility requirements, and understands that the results of the Contest, as determined by Sponsor and its agents, are final in all respects.

 

TIME PERIOD - The Contest shall begin at 8:00 a.m. CST on June 16th, 2025 and shall end at 11:59 p.m. CST on August 1, 2025 (“Contest Period”). Entries received before or after the Contest Period shall be void. Sponsor, at its sole discretion, may elect to cancel the Contest at any time without notice. Additionally, in the event any portion of the Contest is compromised by causes beyond Sponsor’s control which, in the sole opinion of Sponsor, impair the integrity, administration, security, or operation of the Contest, Sponsor reserves the right, in its sole and absolute discretion, to cancel, suspend, extend, abbreviate or terminate the Contest. If Sponsor elects to abbreviate the Contest, winner(s) will be determined from all eligible entries received prior to the action or compromise giving rise to the suspension or termination of this Contest.

 

SELECTION OF WINNER – Throughout the contest period, all eligible photo submissions will be collected and cataloged daily by the Sponsor. Each winner will be selected from the pool of eligible entries based on a combination of internal panel review and public voting. Finalists will be determined with consideration given to need, and winners will be contacted after the contest concludes on August 1, 2025. The odds of winning depend on the total number of eligible entries received during the contest period. Winners will be notified within ten (10) days via the preferred means of contact provided at the time of entry. If, after one (1) attempt through the entrants valid email address or SMS, a potential winner cannot be reached by Sponsor or the winner does not respond within 3 (three) days of notification, the prize shall be forfeited and an alternate winner will be selected from the remaining eligible entries using the procedure specified above. All winning entries are subject to verification by Sponsor, whose decision shall be final. Sponsor is not responsible for any change in mailing address, telephone number or email address of entrants. Non-winning entries will not be carried forward to future contests.

 

PUBLICITY – As a condition of entry into the Contest, except where prohibited by law, each entrant by entering and each winner by accepting their prize grants to Sponsor a perpetual, worldwide, royalty-free license and right to publicize, broadcast, display and/or otherwise use the entrant’s or winner’s name, likeness and derivatives thereof in any media now known or hereafter devised through the world in perpetuity for advertising and publicity purposes, without additional review, compensation, consideration, permission nor approach. 

 

CONTEST PRIZE - Prizes will consist of Home Outlet gift cards in varying dollar amounts, distributed among multiple winners, totaling $5,000.00, which may be redeemed at any Sponsor location for future purchases. The credit is not eligible for use on past purchases. All federal, state and local taxes associated with the receipt or use of any prize, if any, shall be the sole responsibility of the prize winner. By entering the Contest, each prize winner agrees to comply with all federal, state and local reporting requirements. Prizes may not be sold, assigned, transferred, changed, exchanged, substituted or redeemed for cash.

 

DISPUTES - All disputes arising from or relating to the Contest shall be submitted exclusively to the jurisdiction of the state and federal courts located in Jonesboro, Craighead County, Arkansas. Each entrant hereby irrevocably consents to the jurisdiction of such courts and waives all objections thereto. Each entrant hereby irrevocably waives any and all right to trial by jury in any legal proceeding in connection with the Contest, the Terms and Conditions and any and all further transactions contemplated hereby. Except where prohibited, each entrant agrees that any and all disputes which cannot be resolved between or among the parties and any claims or causes of action arising out of or connected with this Contest, any prize awarded, or the determination of the winner shall be resolved individually, without resort to any form of class action. Any and all disputes that arise relating to the Contest must be filed within one (1) year from the end of the Contest Period.

 

INDEMNIFICATION AND LIMITATION OF LIABILITY - BY ENTERING THE CONTEST, EACH ENTRANT RECOGNIZES THAT SPONSOR AND ITS PARENT, AFFILIATE AND SUBSIDIARY COMPANIES MAKE NO EXPRESS OR IMPLIED WARRANTIES AS TO THE PRIZE AND EACH ENTRANT AGREES TO INDEMNIFY, RELEASE AND HOLD HARMLESS SPONSOR AND ITS PARENT, AFFILIATE AND SUBSIDIARY COMPANIES, AND ALL THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS FROM ANY LIABILITY, DAMAGES, LOSSES OR INJURY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM ENTRANT’S PARTICIPATION IN THE CONTEST AND THE ACCEPTANCE, USE OR MISUSE OF ANY PRIZE THAT MAY BE WON. EACH ENTRANT FURTHER RECOGNZIES THAT THE CONTEST IS IN NO WAY SPONSORED, ENDORSED OR ADMINISTERED BY, OR ASSOCIATED WITH, ANY PARTICIPATING PARTIES’ SOCIAL MEDIA CHANNELS, INCLUDING FACEBOOK, TWITTER, TIKTOK, INSTAGRAM AND YOUTUBE, AND AGREES TO INDEMNIFY, RELEASE AND HOLD HARMLESS FACEBOOK, TWITTER, TIKTOK, INSTAGRAM AND YOUTUBE, AND THEIR RESPECTIVE PARENT, AFFILIATE AND SUBSIDIARY COMPANIES, AND ALL THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS FROM ANY LIABILITY, DAMAGES, LOSSES OR INJURY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM ENTRANT’S PARTICIPATION IN THE CONTEST AND THE ACCEPTANCE, USE OR MISUSE OF ANY PRIZE THAT MAY BE WON.

 

MISCELLANEOUS - Headings are provided for reference purposes only and will not be given any substantive effect. The failure by Sponsor to exercise or enforce any right or provision herein shall not constitute a waiver thereof. If any provision herein is held by a court of competent jurisdiction to be invalid or unenforceable, said provision shall be enforced to the maximum extent permitted by law, and the remainder of these Official Rules shall remain in full force and effect.

 

PRIVACY - The use or disclosure of personal information submitted by entrants will be subject to Sponsor’s privacy policy which is located at /privacy-policy.

 

TERMS AND CONDITIONS/WINNERS LIST REQUEST – To obtain a copy of these Terms and Conditions or for a list of winners, send a self-addressed stamped envelope to Sponsor to 2929 Brown’s Lane, Jonesboro, AR 72401. Requests for lists of winners must be received no later than three (3) months after the end of the Contest Period.

 

NO PURCHASE NECESSARY.  – As an alternate method of entry into the Contest, participants may mail a 3-inch x 5-inch card on which the participant has legibly printed his or her first and last name, complete mailing address (e.g., street, city, state and zip code), cellphone number and email address (if available), along with written consent to opt-in to the Home Outlet SMS Program. Mail card to E.C. Barton & Company, Attn: Help Me Out Home Outlet Contest, 2929 Brown’s Lane, Jonesboro, AR 72401. No photocopies or reproductions allowed. Limit one (1) mail-in entry per stamped outer envelope. Mail-in entries must be postmarked by August 1, 2025.
