Customer Review Sweepstakes

Eligibility:

Barton's Home Outlet "Product Review Sweepstakes" (the "Sweepstakes") is open to legal residents of the United States except employees, officers, directors (and their immediate families and those living in their same households) of Barton's Home Outlet, Barton's or E. C. Barton & Company. Participants must be 18 years old or older to enter and win. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s and Administrator’s decisions, which are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein. By entering this Sweepstakes you agree to receive future email notifications and promotions from Barton’s Home Outlet and all of its subsidiaries. Your information will not be shared with third parties.

Promotion Period:

Entries will be accepted for the Sweepstakes annually from November 1st, at 12:00:01 am Eastern Time ("ET") through November 30 the following year at 11:59:59 pm ET. We reserve the right to end this contest at any time.

How to Enter:

During each month in the Promotion Period, you may enter the Sweepstakes by visiting homeoutlet.com and submitting a product review that includes all requested information and conforms to the product review guidelines available for review at powerreviews.com/terms-of-submission-ugc. Your entry will be recorded based on the email provided in the product review. Multiple entrants will not be permitted to share the same email address. Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different email addresses identities, registrations and logins, or any other methods will void that entrant's entries and that entrant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. A valid product review submitted within the Promotion Period will be eligible for entry in the monthly prize drawing for the month in which the product review was submitted and will also count as one (1) entry in the grand prize drawing at the conclusion of the Promotion Period. Entrants may review multiple products; however, only one entry per product review of purchased item(s) will be accepted.

Prize Drawings:

One (1) monthly regular prize winner will be selected in a random drawing occurring each month from all eligible entries received during the Promotion Period and one (1) grand prize winner will be selected at random in January, annually. The potential winners will be notified by email. Prize must be picked up at the Home Outlet store location nearest the winner. Gift cards can not be used for online purchases. Failure to respond to the notification within five (5) business days from the date of the Sweepstakes drawing will result in disqualification and an alternate winner will be selected at random. Potential winner will be required to respond to Sponsor via email, within five (5) business days of the date notice or attempted notice is sent. Potential winner continuing to comply with all terms and conditions of these Official Rules and winning are contingent upon fulfilling all requirements. In the event that a potential winner is disqualified for any reason, Sponsor will award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries. Only three (3) alternate drawings will be held, after which the prize will remain un-awarded. Prize will be fulfilled approximately 2-4 weeks after winner is confirmed. Sweepstakes parties reserve the right to modify the notification procedures in connection with the selection of alternate winner(s), if any. All entries are subject to verification prior to awarding of prizes. Eligibility, age and claims made by prize winners also are subject to verification prior to awarding prizes.

Any and all taxes on the prize, and any other costs, fees, and expenses not explicitly stated herein are the sole responsibility of the prize recipient.

Prizes:

One (1) regular monthly winner will be selected at random to receive one (1) $100 Home Outlet Gift Card (*Extra $100 for monthly entries that include photos of completed project). One (1) Grand Prize winner will be selected at random in January, annually, to receive one (1) $1,000 Home Outlet Gift Card. A Gift Card is awarded on an “as is” basis, and cannot be redeemed for cash or used as payment for purchases of additional Gift Cards or as an adjustment to prior purchase(s) or applied as payment on any account. Gift Card will not be replaced if lost or stolen. Odds of winning a prize will depend on the number of eligible Entries received during the Promotion Period. Prizes pictured in advertising, marketing or promotional materials are for illustrative purposes only. Any applicable taxes and all other costs/expenses not specifically identified in these Official Rules are the sole responsibility of winner. Prize is nontransferable, and no substitutions or cash redemptions will be made, other than as provided herein. Sponsor reserves the right to substitute a prize, in whole or in part, of equal or greater monetary value if a prize cannot be awarded, in whole or in part, as described for any reason.

Release:

By receipt of any prize, each winner agrees to release and hold harmless Sponsor, Administrator, and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the "Released Parties") from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Sweepstakes or receipt or use or misuse of any prize.

Publicity:

Except where prohibited, participation in the Sweepstakes constitutes each winner’s consent to Sponsor’s and its agents’ use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.

General Conditions:

Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. ANY ATTEMPT BY ANY PERSON TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAW, AND, SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

Limitations of Liability:

The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or hardware or software errors; faulty computer, telephone, cable, satellite, network, electronic, wireless, or Internet connectivity, or other online communication problems; errors or limitations of any Internet service providers, servers, hosts, or providers; garbled, jumbled, or faulty data transmissions; failure of any email transmissions to be sent to or received; lost, late, delayed, or intercepted email transmissions; inaccessibility of the website in whole or in part for any reason; traffic congestion on the Internet or website; (3) unauthorized human intervention in any part of the entry process or the Sweepstakes; (4) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use or misuse of any prize. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Sweepstakes, provided that, if it is not possible to award another entry due to discontinuance of the Sweepstakes, or any part of it, for any reason, Sponsor, in its sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.

Jury Trial Waiver:

Except where prohibited by law and as a condition of participating in this Sweepstakes, entrant hereby waves any right it may have to a trial by jury in respect of any litigation directly or indirectly arising out of, under, or in connection with this Sweepstakes, any document or agreement entered into in connection herewith and any of the transactions contemplated hereby or thereby.

Entrant's Personal Information:

Information collected from entrants is subject to Barton's Home Outlet Privacy Policy.

Governing Law and Jurisdiction:

The conduct of this Sweepstakes and the application of these Official Rules shall be governed by the law of the state of Arkansas USA, whose courts shall have exclusive jurisdiction in the event that any dispute arises regarding the Sweepstakes or prize.

NO PURCHASE NECESSARY

– As an alternate method of entry into the Sweepstakes, participants may mail a 3-inch x 5-inch card on which the participant has legibly printed his or her first and last name, complete mailing address (e.g., street, city, state and zip code), daytime telephone number and email address (if available). Mail card to E.C. Barton & Company, Attn: Customer Review Sweepstakes, 2929 Brown’s Lane, Jonesboro, AR 72401. No photocopies or reproductions allowed. Limit one (1) mail-in entry per stamped outer envelope. Mail-in entries will be entered in the monthly drawing for the month in which the entry is received. To be eligible for the grand prize drawing, the mail-in entry must be postmarked by the last day of the Promotion Period and must be received within seven (7) days of the end of the Promotion Period.
