Official Photo Contest Rules For Home Outlet:

• PHOTOS SHOULD NOT INCLUDE TEXT, TIME OR DATE STAMPS AND MUST BE INDIVIDUAL IMAGES, NOT MULTIPLE IMAGES IN THE SAME FILE.

• One $1,500 Home Outlet grand prize gift card winner will be chosen at the end of the contest and one $250 monthly Home Outlet gift card winner will be chosen each month (For a total of five, $250 Home Outlet gift cards from March through July, 2024). The monthly winners will be selected by an internal E. C. Barton & Company panel and the grand prize winner at the end of the contest by public voting online (to be determined after the contest has ended at a later date. The top 10 entries will be selected by our internal panel). The winners will be notified by their valid email address. We reserve the right to end this contest at any time. Prize must be picked up at the location nearest to the winner.

• Prize award will be issued as an E.C. Barton & Company gift card valid at Home Outlet.

• Photos must be either: JPEG, PNG, or TIFF formats. Videos are welcome but must be in MOV or MPG file formats. Files cannot be larger than 10 megabytes.

Limit of 6 images or videos per entry. Multiple entries by the same person will be accepted, but entering the same image multiple times does not increase chances of winning.

• All entries become the property of E. C. Barton & Company. By entering the contest you grant E. C. Barton & Company and its subsidiaries permission to use your photographs (and likeness) without restriction.

• Winners will be selected from entries made on homeoutlet.com. Winners must acknowledge they’ve won within one week of being notified and we reserve the right to select a new winner

E.C. Barton & Company d/b/a Barton’s Home Outlet (“Sponsor”) runs various sweepstakes and contests (“Sweepstakes”) from time to time and are governed by these official rules (“Official Rules”). By participating in the Sweepstakes, each entrant agrees to abide by these Official Rules, including all eligibility requirements, and understands that the results of the Sweepstakes, as determined by Sponsor and its agents, are final in all respects. The Sweepstakes is subject to all federal, state and local laws and regulations and is void where prohibited by law. Any questions, concerns or complaints regarding the promotion will be directed to the Sponsor.

ELIGIBILITY - The Sweepstakes is open to any US citizen currently residing in the US who is 18 years of age or older by the start of this contest, except where prohibited by law. Sponsor reserves the right to verify the eligibility of each entrant.

 

TIME PERIOD - Each Sweepstakes shall begin when made public and will end at various times. Sponsor may post specific time periods for each contest on its website (“Sweepstakes Period”). All entries must be received on or before the conclusion of the Sweepstakes Period as entries received after the Sweepstakes Period shall be void.

 

HOW TO ENTER - Entry may be made via the Sponsor’s web pages. Entrants must fill out all required fields on the entry form to participate. By entering, each entrant confirms that they meet the eligibility requirements as set out above and each entrant may submit only one (1) entry. All entries become the property of the Sponsor.

 

SELECTION OF WINNER(S) - Winners will be chosen by public voting from the top 25 entries selected by our panel of judges from all eligible entries at the end of the Sweepstakes Period. The selection process run by the Sponsor is final. The winner will be announced on specific dates that may be listed below. If a potential prize winner cannot be reached by the Sponsor within ten (10) days, using the contact information provided at the time of entry, that potential prize winner shall forfeit the prize.

 

SWEEPSTAKES PRIZES - All awards and prizes will be posted below per the specific sweepstakes. ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZE, IF ANY, ARE SOLELY THE RESPONSIBILITY OF THE WINNER.

 

ADDITIONAL LIMITATIONS - Prizes are non-transferable. No substitution or cash equivalent of prizes is permitted. Sponsor reserves the right, in its sole discretion, to cancel or suspend the Sweepstakes. In the event any portion of this Sweepstakes is compromised by causes beyond Sponsor’s control which, in the sole opinion of Sponsor, impair the integrity, administration, security, or operation of this Sweepstakes, Sponsor reserves the right to cancel, suspend, extend, abbreviate or terminate the Sweepstakes if it determines, in its sole discretion, that the submission process has been impaired, compromised, undermined, or corrupted in such manner that would undermine the integrity, security, safety, success and/or feasibility of the Sweepstakes. If Sponsor elects to abbreviate the Sweepstakes, Winner(s) will be determined from all eligible entries received for Drawing(s) prior to the action or compromise giving rise to the suspension or termination of this Sweepstakes.

 

DISPUTES - All disputes arising from or relating to the Sweepstakes shall be submitted exclusively to the jurisdiction of the state and federal courts located in the State of Arkansas. Each entrant hereby irrevocably consents to the jurisdiction of such courts and waives all objections thereto. Each entrant hereby irrevocably waives any and all right to trial by jury in any legal proceeding in connection with the Sweepstakes, the Official Rules & Regulations and any and all further transactions contemplated hereby. Except where prohibited, each entrant agrees that any and all disputes which cannot be resolved between or among the parties and any claims or causes of action arising out of or connected with this Sweepstakes, any prize awarded, or the determination of the winner shall be resolved individually, without resort to any form of class action. Any and all disputes that arise relating to the Sweepstakes must be filed within one (1) year from the date that the winner(s) is announced.

 

INDEMNIFICATION AND LIMITATION OF LIABILITY - BY ENTERING THE SWEEPSTAKES, ENTRANT RECOGNIZES THAT SPONSOR AND ITS PARENT, AFFILIATE AND SUBSIDIARY COMPANIES MAKE NO EXPRESS OR IMPLIED WARRANTIES AS TO THE PRIZE AND EACH ENTRANT AGREES TO INDEMNIFY, RELEASE AND HOLD HARMLESS SPONSOR AND ITS PARENT, AFFILIATE AND SUBSIDIARY COMPANIES, AND ALL THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS FROM ANY LIABILITY, DAMAGES, LOSSES OR INJURY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THAT ENTRANT’S PARTICIPATION IN THE SWEEPSTAKES AND THE ACCEPTANCE, USE OR MISUSE OF ANY PRIZE THAT MAY BE WON.

 

MISCELLANEOUS - Headings are provided for reference purposes only and will not be given any substantive effect. The failure to exercise or enforce any right or provision herein shall not constitute a waiver thereof. If any provision herein is held by a court of competent jurisdiction to be invalid or unenforceable, said provision shall be enforced to the maximum extent permitted by law, and the remainder of these Official Rules shall remain in full force and effect.

PRIVACY - The use or disclosure of personal information submitted by entrants will be subject to Sponsor’s privacy policy which is located at https://www.homeoutlet.com/terms-and-policies#privacy. Except where prohibited by law, acceptance of the prize will constitute WINNER’S agreement to allow Sponsor to use the WINNER’S name, photo, and/or likeness in any and all media without limitation as to time or territory, and without attribution, compensation, permission or notification to the Entrant or any other party.
