One (1) winner for each prize will be selected at random from all eligible entries received for the Omaha Grand Opening Giveaway, to be determined at a later date after the contest has ended, winner will be selected by the Sponsor from all valid submissions made on Sponsor’s web page at homeoutlet.com. Winner will be notified by their valid email address. Sponsor reserves the right to end this contest at any time. Prize must be picked up at the Omaha, NE location. Winners must acknowledged that they have won within seven (7) days of being notified or we reserve the right to select a new winner.

ELIGIBILITY - The Sweepstakes is open to legal residents of the fifty (50) United States and the District of Columbia who are eighteen (18) years of age or older at the time of entry, except where prohibited by law. Sponsor reserves the right to verify the eligibility of each entrant. Employees, former employees, and relatives of employees are excluded from entering. Sponsor reserves the right to disqualify entrants if there is evidence of tampering. By participating in the Sweepstakes, each entrant agrees to abide by these Official Rules, including all eligibility requirements, and understands that the results of the Sweepstakes, as determined by Sponsor and its agents, are final in all respects.

 

TIME PERIOD - Each Sweepstakes shall begin when made public and will end at various times. Sponsor may post specific time periods for each contest on its website (“Sweepstakes Period”). All entries must be received on or before the conclusion of the Sweepstakes Period as entries received after the Sweepstakes Period shall be void. 

 

HOW TO ENTER - Entries must be submitted through the registration form available on the Home Outlet Grand Opening webpage or through the QR code displayed at the participating Omaha store. Entrants must fill out all required fields on the entry form to participate. By entering, each entrant confirms that they meet the eligibility requirements as set out above and agree to the Official Rules and Sponsor’s decisions, which are final and binding in all matters relating to the Sweepstakes. Automated entries are prohibited, and use of any automated devices will result in disqualification. Receipt of entries may not be acknowledged and proof of submission will not be deemed to be proof of receipt by Sponsor. All entries become the property of the Sponsor. Sponsor is not responsible for any lost, late, undelivered, misdirected, incorrect or inaccurate entries whether caused by hardware, software, or Internet resources associated with or utilized for the Sweepstakes whether caused by technical or human error during the submission and/or processing of entries.

SELECTION OF WINNER(S) - Winners will be chosen by random drawing from all eligible entries at the end of the Sweepstakes Period. The random selection process run by the Sponsor is final. The winners will be announced on specific dates that may be listed below. If a potential winner does not respond within seven (7) days after notification, the prize will be forfeited and an alternate winner may be selected. A confirmed winner will have thirty (30) days from notification to pick up the prize. If the prize is not picked up within (30) days after notification, the winner shall forfeit the prize. If a potential winner forfeits a prize, an alternate winner may be selected. Limit one (1) prize per entrant per drawing. Sponsor is not responsible for any change in mailing address, telephone number or email address of entrants. Non-winning entries will not be carried forward to future sweepstakes.

ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZE, IF ANY, ARE SOLELY THE RESPONSIBILITY OF THE WINNER.

 

ADDITIONAL LIMITATIONS - Prizes are non-transferable. No substitution or cash equivalent of prizes is permitted. In the event any portion of this Sweepstakes is compromised by causes beyond Sponsor’s control which, in the sole opinion of Sponsor, impair the integrity, administration, security, or operation of this Sweepstakes, Sponsor reserves the right to cancel, suspend, extend, abbreviate or terminate the Sweepstakes if it determines, in its sole discretion, that the submission process has been impaired, compromised, undermined, or corrupted in such manner that would undermine the integrity, security, safety, success and/or feasibility of the Sweepstakes. If Sponsor elects to abbreviate the Sweepstakes, Winner(s) will be determined from all eligible entries received for Drawing(s) prior to the action or compromise giving rise to the suspension or termination of this Sweepstakes. 

 

DISPUTES - All disputes arising from or relating to the Sweepstakes shall be submitted exclusively to the jurisdiction of the state and federal courts located in the State of Arkansas. Each entrant hereby irrevocably consents to the jurisdiction of such courts and waives all objections thereto. Each entrant hereby irrevocably waives any and all right to trial by jury in any legal proceeding in connection with the Sweepstakes, the Official Rules & Regulations and any and all further transactions contemplated hereby. Except where prohibited, each entrant agrees that any and all disputes which cannot be resolved between or among the parties and any claims or causes of action arising out of or connected with this Sweepstakes, any prize awarded, or the determination of the winner shall be resolved individually, without resort to any form of class action. Any and all disputes that arise relating to the Sweepstakes must be filed within one (1) year from the date that the winner(s) is announced. 

 

INDEMNIFICATION AND LIMITATION OF LIABILITY - BY ENTERING THE SWEEPSTAKES, EACH ENTRANT RECOGNIZES THAT SPONSOR AND ITS PARENT, AFFILIATE AND SUBSIDIARY COMPANIES MAKE NO EXPRESS OR IMPLIED WARRANTIES AS TO THE PRIZE AND EACH ENTRANT AGREES TO INDEMNIFY, RELEASE AND HOLD HARMLESS SPONSOR AND ITS PARENT, AFFILIATE AND SUBSIDIARY COMPANIES, AND ALL THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS FROM ANY LIABILITY, DAMAGES, LOSSES OR INJURY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THAT ENTRANT’S PARTICIPATION IN THE SWEEPSTAKES AND THE ACCEPTANCE, USE OR MISUSE OF ANY PRIZE THAT MAY BE WON. 

 

MISCELLANEOUS - Headings are provided for reference purposes only and will not be given any substantive effect. The failure to exercise or enforce any right or provision herein shall not constitute a waiver thereof. If any provision herein is held by a court of competent jurisdiction to be invalid or unenforceable, said provision shall be enforced to the maximum extent permitted by law, and the remainder of these Official Rules shall remain in full force and effect.

 

PRIVACY - The use or disclosure of personal information submitted by entrants will be subject to Sponsor’s privacy policy which is located at /privacy-policy. Except where prohibited by law, acceptance of the prize will constitute WINNER’S agreement to allow Sponsor to use the WINNER’S name, photo, or likeness in any and all media without limitation as to time or territory, and without attribution, compensation, permission or notification to the Entrant or any other party.
